TERMS & CONDITIONS
These terms & conditions apply to all orders placed with Rocky Mountain Apparel (“RMA”). Certain provisions apply specifically to customer-supplied (contract) garments and are noted where applicable.
QUOTES & PRICING
All quotes are valid for thirty (30) days unless otherwise stated. Pricing is subject to change without notice due to garment availability, supplier pricing, or production requirements.
ORDERS & PRODUCTION TIMELINE
Production timelines begin once all of the following have been received: customer purchase order, decoration instructions, approved artwork, required garments (if customer-supplied), and any required deposits or payments.
Standard production lead time is ten (10) business days, excluding weekends and holidays, unless otherwise agreed in writing. All completion dates are estimates and are not guaranteed.
Incorrect, discrepant, backordered, or replacement garments may delay production.
RUSH ORDERS
Rush services for orders requiring completion in less than ten (10) business days are evaluated on a case-by-case basis and may incur additional fees. Customers are encouraged to confirm availability prior to placing rush orders.
GARMENT SUPPLY AND AVAILABILITY
RMA-SUPPLIED GARMENTS
Garments are ordered after the order is placed. RMA cannot guarantee manufacturer availability and is not responsible for items that become out of stock, discontinued, or backordered. Substitute garments may be proposed for approval.
CUSTOMER-SUPPLIED (CONTRACT) GARMENTS
Drop-shipped goods must be clearly labeled with the customer name and matching PO or reference number. Mis-labeled or unidentified packages may be subject to receiving and handling fees.
GARMENT VARIATIONS & MANUFACTURING TOLERANCES
Not all garments are manufactured to decorating specifications. Variations in fabric, dye lot, color shade, sizing, sewing, or construction are inherent to the manufacturing process and are not considered defects.
Color appearance may vary between garment styles, sizes, or production runs. Ink and thread colors may appear differently depending on garment color, fabric type, and decoration method. Exact color matches are not guaranteed.
SPOILAGE, OVERRUNS, AND UNDERRUNS
A 2% industry-standard spoilage allowance, or one (1) piece, whichever is greater, may occur during production and is considered acceptable.
Final quantities may vary by ±5% due to spoilage, setup, or production variance and will be billed accordingly unless otherwise specified in writing.
For customer-supplied garments, RMA’s financial responsibility for damaged goods begins only after the spoilage allowance has been exceeded and is limited to the cost of decoration services only.
ARTWORK, MOCKUPS, AND PROOFS
Artwork must be provided in vector format with text converted to outlines. Pantone Solid Coated color codes are required for specified colors. Other color formats will be converted as closely as possible; exact matches are not guaranteed.
Digital mockups and proofs are for layout and placement reference only. Final printed or embroidered products may vary slightly in appearance due to production realities.
Customer approval of proofs is contractually binding. Errors approved by the customer are the customer’s responsibility, including all original production costs, corrections, and reprints. Decorated garments cannot be returned or exchanged.
Customers are solely responsible for confirming copyright, trademark, and licensing permissions and agree to indemnify RMA from any related claims.
PLACEMEMT AND DECORATION TOLERANCES
Exact placement cannot be guaranteed. Industry-standard placement tolerances of up to ±½ inch are considered acceptable.
For embroidery, small text, fine detail, or thin line work may not reproduce cleanly. Minor production adjustments may be made to ensure the best possible result.
WASH, WEAR, AND CARE
RMA is not responsible for damage caused by improper washing, drying, or garment care. Manufacturer care instructions should be followed. Normal wear and washing may affect decorated garments over time.
CANCELLATIONS
Cancellations made after estimate approval may be subject to restocking fees, supplier return fees, shipping costs, and labor charges incurred.
No cancellations will be accepted once production or decoration has begun.
PAYMENT TERMS
Payment in full is due upon pickup or prior to shipment unless otherwise arranged in writing. Payment terms are not assumed. Past-due invoices may be subject to finance charges.
SHIPPING, RISK OF LOSS AND DECLARED VALUE
Risk of loss transfers to the customer upon pickup or shipment. Shipping claims must be reported within three (3) business days of delivery.
Customers requesting shipment are responsible for providing accurate delivery and insurance information. RMA is not responsible for carrier delays or transit damage beyond declared value.
ERRORS, CLAIMS, AND REMEDIES
Claims must be submitted within three (3) business days of pickup or delivery. Goods must be returned for review within two (2) weeks.
If an error is confirmed, RMA’s sole obligation is limited to reprint, repair, or credit at its discretion. RMA is not responsible for consequential damages, lost sales, or missed events.
STORAGE AND ABANDONED GOODS
Orders not picked up or scheduled for shipment within ninety (90) days of completion may be subject to storage fees. After ninety (90) days, RMA reserves the right to dispose of or donate abandoned goods without compensation.
DELAYS AND FORCE MAJEURE
RMA shall not be held responsible for delays caused by circumstances beyond its reasonable control, including supplier delays, shipping carriers, weather, equipment failure, power outages, labor disputes, or supply chain disruptions.
